Our privacy policy

We have a privacy policy so that you can be sure that your data is protected.

Privacy

With this privacy policy, we – KIWI.KI GmbH, represented by the managing directors Karsten Nölling (CEO) and Dr. Claudia Nagel, Wattstrasse 11, 13355 Berlin, Germany – wish to inform you of the kind of data we gather from you and how we use this data when you visit our website or make use of our services.

When you agree to these data protection provisions, which you must do in order to be able to register on our website, you consent to us gathering, processing, and using your personal data as set out below. This consent is granted during the registration process by clicking on the corresponding box. The consent granted is logged and can be revoked at any time.

1. Our principles when handling your data

Your trust is important to us! That is why we are committed to data reduction and data economy. We act strictly in accordance with legal regulations when handling your data in any way (e.g. when gathering, processing, and using it). Data is only gathered, processed, and used on the basis of a contract concluded with us and the consent granted by you, unless already permitted by law.

2. The purpose of gathering data

We provide specific services on our website and gather personal data for this purpose, insofar as you have granted your consent for us to do so. Data is gathered to provide contractual services to the necessary extent as well as improve and maintain business relationships, perform quality assurance and quality improvement tasks, carry out technical checks and render our services, maintain security aspects, and further develop products. It is also gathered for advertising and marketing purposes.

3. Gathering, processing, and using personal data

We only gather personal data if you voluntarily provide such information (and thereby grant your consent) for the purposes of contacting us, opening a customer account, concluding a contract, performing contractual services, or subscribing to our newsletter. Without your special consent, we use the data you provide solely to fulfill and perform our obligations arising from the contractual relationship. Once the obligations arising from the contractual relationship have been met in full, a block will be placed on your data, preventing further use. It will then be deleted once the statutory period for retaining such data has expired in accordance with taxation and commercial laws, unless you have expressly consented to the continued use of your data.

3.1. What kind of data do we gather as part of the contractual relationship?

You must provide us with certain personal and relevant data when opening a customer account or entering into a contractual relationship. We use this data solely for performing services arising from the contractual relationship. In particular, the following data is gathered and processed: first name and surname, date of birth, registered address, address of the property for KIWI door entry services, first and surname of the owner (where necessary) together with the address and contact details, name, address, and contact details of the property management company (where necessary), telephone number, e-mail address, payment information (bank details, credit card details (where necessary), or PayPal account details, etc.), password and username, ID details (where necessary), and answers to your security questions (e.g. the question about your favorite holiday destination).

3.2. What kind of data do we gather and process for the purposes of using our door entry services?

When using the KIWI Ki or our KIWI App, the KIWI door unit checks whether the KIWI Ki or KIWI App you are using has access rights to the corresponding door. In the course of this data exchange, the KIWI Ki or KIWI App sends an encrypted temporary ID (effectively the key to the lock), which ultimately grants hands-free access and is not linked to your personal data. Furthermore, this door opening process in neither stored nor logged by us. When using our door entry services, however, we continuously store and process data on the current operating status of our technical equipment, which includes the KIWI Ki or KIWI App used by you. We gather and process this data solely for the purposes of providing our services, monitoring the system, and checking for instances of misuse. If you use our KIWI App for our door entry services, we log your location data. We use this data solely to guarantee the functionality of our door entry services. We do not store your location data.

3.3. What kind of data do we gather and process when you interact with us via the website or app?

When you visit our website, we store the IP address of your computer, the type of browser and request, the operating system used, the page accessed, the previously visited page, and the time of your request. We use this data to operate our website and especially for the purposes of rectifying faults and modifying and improving our systems to meet your needs, as well as for statistical purposes. The IP address is only stored while the website is being used. It is subsequently deleted or anonymized by shortening it.

When accessing your customer account, we may also gather and store additional actions of contractual relevance (e.g. the granting of access rights, KIWI Ki follow-up orders, changes to your customer data, notices of cancellation, e-mail correspondence with the support team, etc.) in order to meet all contractual obligations. The same applies when you contact us via other channels (e.g. by telephone, fax, or letter).

We also gather information on how you use our website by using so-called browser cookies, which are stored as text files on your end device and store certain settings and data to exchange with our system via your browser. Cookies allow our systems to identify the user’s end device and immediately make available any previous settings. Cookies help us to improve our website and enable us to offer you a better service.

Only the aforementioned data relating to the use of our website is stored in the cookies we use. This is done by assigning a cookie ID and not by allocating the data to you personally. The cookie ID is not merged with your personal data.

Our website also uses so-called Web analysis services, which also use cookie technology. We use this technology to gain insights into your usage behavior. These insights help us to improve our website and/or make the content even more interesting for you. By recording usage behavior in profiles, we can make product suggestions based on previously determined and stored page visits, but also show advertising and other content tailored to the individual user. The usage behavior is analyzed under a pseudonym and no usage profile is merged with your personal data.

If you do not want browser cookies to be used, you can set your browser so that it does not accept the storage of cookies. Alternatively, you can also prevent the storage and processing of data using the following link: http://tools.google.com/dlpage/gaoptout?hl=de. Please note that in this case, access to our website and/or the services provided therein may be restricted or not available at all.

4. What kind of personal data do we pass on to third parties?

When using our chargeable services, we pass on the necessary billing information to the financial institution or credit card company handling the payment transaction. If proof of identity is required when concluding a contract and you choose the optional POSTIDENT identity check, we will relay the necessary personal data to Deutsche Post AG. Otherwise, identity checks will be performed by our employees, who may pass on your personal data to the relevant residents’ registration office for the purposes of making an enquiry, if necessary. Furthermore, your data may be passed onto any shipping company charged with the task of making any deliveries or any company charged with the task of installing the door unit, insofar as this is necessary for the delivery or installation of goods. When using our chargeable services, we will inform the property owner and/or property management company of the number of access rights being used by you, insofar as we receive a request for this information from the owner or property management company.

You have the option of registering with our partner company, Deutsche Post AG, for the E-Postbrief service via our website. If you make use of this option, we will pass on the necessary data (your first name and surname, date of birth, place of birth, address, and e-mail address) to Deutsche Post AG.

Depending on the usage agreement, you will receive free key insurance from Allianz Versicherungs-AG. We will pass on the necessary data (your first name and surname, address, date of birth, and Ki ID) to Allianz Versicherungs-AG so that you can benefit from this service.

Your data will not be passed onto anyone else without your express consent, unless we are entitled or duty-bound to do so in line with legal regulations and/or official or judicial instructions. This may be the case, for example, in the event of criminal investigations.

5. Will the data be sent abroad?

No data is currently sent abroad and there is also no intention to do so, unless we expressly point it out in this privacy policy.

6. Passing on data in connection with the use of plug-ins

Our website incorporates so-called plug-ins from social networks, whose services are provided by the respective company (Facebook, Google+, Twitter). You can identify the plug-ins by the button used by each social media company, e.g. the “Like” or “Share” button from Facebook. Automatic data exchange takes place between our website and the website of the relevant social media network via your browser with the aid of the plug-ins embedded in our website. As such, when accessing our website, for example, the IP address is relayed to the social network, even if you are not a registered user there.

If you are a registered user of a social network and you access our website without having logged out of the social network beforehand, the social network can (as far as we are aware) assign your visit to our website to your account. Furthermore, if you interact with the plug-in as a logged-in user of the social network – by clicking on the Facebook “Share” button, for instance – this information may be published by the social network. As far as we are aware, the data is stored abroad. We have no influence on the extent or type of data that is relayed, nor how this data is further processed.

Data exchange takes place in accordance with the guidelines of the individual social network. You can find out more detailed information about the plug-ins used by Facebook, Google, and Twitter and the privacy policies of the respective social networks via the following links:

In order to restrict the collection of data by social networks that we are unable to control, we have prevented data from being passed on by putting technical measures in place. Accordingly, we have made sure that no data can be relayed to the aforementioned social networks by accessing our website. This will only be possible once you activate the button of the respective social network incorporated on our website by clicking on it.

7. Changes to this privacy policy

We are continuously working to improve our services for you. In doing so, we will always keep our privacy policy up to date and adapt it accordingly, as and when necessary. You will always find an up-to-date version of the privacy policy on our website.

8. Requesting information, revoking your consent, and amending, blocking, or deleting your data

You can request information on the data we have stored about you at any time. You can revoke (in full or part) the consent granted to us when you agreed to the provisions set out in this privacy policy to gather, process, and use your personal data. The same applies to any later, continuing consent granted to gather, process, or use your personal data. As a consequence of such a revocation of consent, you may no longer be able to use our services or you may only have restricted access to them. Furthermore, you can ask us to amend any incorrect data and block or delete your data at any time.

9. Office / contact point responsible for privacy

If you have any questions on the gathering, processing, or use of your data, if you wish to amend, block, or delete your data or if you wish to revoke your consent, please contact KIWI.KI GmbH, Wattstrasse 11, 13355 Berlin, Germany.

10. Protecting your data

We have put a number of technical and organizational measures in place to protect your data from misuse or loss by third parties and we are constantly improving such measures.

11. Newsletter

If you have separately subscribed to our newsletter, we will use your e-mail address stored on our system for our own advertising purposes. You can unsubscribe from the newsletter at any time by clicking on the link at the end of each newsletter.
